By accessing this website, downloading any content, or completing a purchase, you confirm that you have read, understood, and agreed to be bound by these Terms in their entirety. If you do not agree, do not use this website or purchase any products.

1.  Who We Are

Miavela Wellness is an educational health content brand operated by a private individual registered in Lithuania, European Union. Miavela Wellness creates and distributes digital educational content — including but not limited to PDFs, protocols, guides, course materials, and free lead magnets — focused on metabolic health, insulin resistance, blood sugar regulation, keto and intermittent fasting.

Miavela is not a medical practice, clinic, healthcare provider, or pharmaceutical company. We are an educational publisher of health-related information.

2.  Acceptance of Terms

By using this website or purchasing any Miavela product, you confirm that you accept these Terms and Conditions in full. These Terms apply to all visitors, users, purchasers, and subscribers.

3.  Health and Medical Disclaimer

All content published by Miavela Wellness — including website content, social media content, videos, PDFs, protocols, guides, email newsletters, and any other materials — is provided for EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY.

•       Miavela content does NOT constitute medical advice, diagnosis, or treatment.

•       Miavela content does NOT replace the advice, diagnosis, or treatment of a qualified healthcare professional.

•       Miavela content is NOT intended to diagnose, treat, cure, or prevent any disease or health condition.

•       Nothing communicated by Miavela — in any format, on any platform — should be interpreted as a substitute for professional medical consultation.

You understand and acknowledge that: individual responses to dietary, lifestyle, and health interventions vary significantly; the mechanisms and protocols described by Miavela Wellness are educational in nature and may not apply to your specific health situation; and that you should always consult a qualified healthcare provider before making any changes to your diet, exercise routine, supplementation, or medical treatment.

Miavela expressly disclaims all liability for any adverse effects, health outcomes, or consequences arising from the application of any information, protocol, or guidance provided through any Miavela Wellness platform or product. Use of Miavela content is entirely at your own risk.

4.  Intellectual Property — Ownership and Protection

This section governs the ownership, licensing, and permitted use of all Miavela intellectual property. It applies to every product, free or paid, distributed under the Miavela Wellness brand.

4.1  Ownership

All content created and distributed by Miavela — including but not limited to written documents, PDFs, protocols, guides, course materials, scripts, frameworks, visual designs, brand identity elements, free lead magnets, email sequences, social media content, video scripts, and any derivative works — is the exclusive intellectual property of Miavela Wellness brand.

This content is protected under:

•       Lithuanian copyright law (Lietuvos Respublikos autorių teisių ir gretutinių teisių įstatymas)

•       European Union copyright directives, including Directive 2019/790/EU on Copyright in the Digital Single Market

•       The Berne Convention for the Protection of Literary and Artistic Works, to which Lithuania is a signatory

•       Applicable international intellectual property treaties

Copyright protection is automatic upon creation and does not require registration. All rights are reserved.

4.2  License Granted to Purchasers

Upon purchase of any Miavela Wellness paid digital product, you are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable personal license to:

•       Access and read the purchased content for your own personal, non-commercial use

•       Apply the educational information to your personal health journey

This license explicitly excludes and prohibits the following uses:

4.3  Strictly Prohibited Uses — Paid Products

The following actions constitute a breach of these Terms and an infringement of Miavela's intellectual property rights, regardless of whether they are carried out for profit or not:

1.    Reproducing, copying, or duplicating any Miavela product in whole or in part

2.    Distributing, sharing, uploading, or transmitting any Miavela product to any third party by any means, including email, file sharing, cloud storage, or social media

3.    Selling, reselling, sublicensing, or otherwise commercially exploiting any Miavela product

4.    Using any Miavela content to create competing products, courses, guides, or materials — whether sold or given away for free

5.    Presenting, publishing, or distributing any Miavela content under your own name or brand as if it were your original work

6.    Using any Miavela content in any commercial context, including but not limited to coaching services, consultation services, social media monetization, or advertising

7.    Translating, adapting, summarizing, or creating derivative works from any Miavela content without explicit written permission

8.    Removing, obscuring, or altering any copyright notices, watermarks, or ownership statements embedded in Miavela products

4.4  Strictly Prohibited Uses — Free Lead Magnets

Free Miavela Wellness materials — including but not limited to The Metabolic Diagnostic, free PDF guides, and email content — are subject to identical intellectual property protections as paid products. The fact that no money changed hands does not transfer any rights to the recipient. All prohibitions listed in Section 4.3 apply in full to free materials.

4.5  Consequences of Infringement

Unauthorized use of Miavela intellectual property will result in:

•       Immediate revocation of your license and access to all Miavela Wellness products

•       A formal cease and desist notice

•       A claim for damages under applicable copyright law, including statutory damages where available

•       Reporting to relevant platform operators (including but not limited to TikTok, Instagram, Facebook, YouTube, Pinterest) for content removal under DMCA or equivalent procedures

•       Legal action in Lithuanian courts or courts of competent jurisdiction in the infringer's country

Under EU copyright law, Miavela Wellness is entitled to seek injunctive relief, actual damages, statutory damages, and recovery of legal costs from infringers.

5.  User Conduct

By using Miavela platforms and purchasing Miavela products, you agree that you will not: use any Miavela content to spread misinformation; misrepresent Miavela's content as medical advice to others; use Miavela's brand name, logo, or visual identity in any way without written permission; or engage in any conduct that damages Miavela's reputation or business.

6.  Disclaimer of Warranties

Miavela products and content are provided 'as is' and 'as available' without warranties of any kind, express or implied. While Miavela makes every effort to ensure the accuracy and quality of its educational content, we do not warrant that: the content is free from errors or omissions; the content is suitable for your individual health circumstances; or that following any protocol described will produce any specific health outcome.

To the maximum extent permitted by applicable law, Miavela disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.  Limitation of Liability

To the maximum extent permitted by applicable EU and Lithuanian law, Miavela's total liability to you for any claim arising from your use of our products or content shall not exceed the amount you paid for the specific product giving rise to the claim. Miavela shall not be liable for any indirect, incidental, consequential, special, or punitive damages of any kind.

Nothing in these Terms limits Miavela's liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under EU law.

8.  Privacy and Data

Miavela collects and processes personal data in accordance with the General Data Protection Regulation (GDPR) and Lithuanian data protection law. By purchasing from or subscribing to Miavela Wellness, you consent to the collection and processing of your data as described in Miavela's Privacy Policy, which is incorporated into these Terms by reference. Your data will never be sold to third parties.

9.  Governing Law and Jurisdiction

These Terms and any disputes arising from them are governed by the laws of the Republic of Lithuania and, where applicable, European Union law. Any legal proceedings arising from these Terms shall be brought in the competent courts of Lithuania, without prejudice to your rights as an EU consumer under applicable consumer protection law.

If you are a consumer resident in another EU member state, you may also have the right to bring proceedings in the courts of your country of residence under applicable EU consumer law.

10.  Changes to These Terms

Miavela reserves the right to update these Terms at any time. Updated Terms will be posted on this website with a revised effective date. Your continued use of Miavela products or platforms after any update constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

MIAVELA — REFUND POLICY

This Refund Policy applies to all paid digital products sold by Miavela.

1.  No-Refund Policy — Digital Products

Due to the digital nature of all Miavela products, all sales are final.

Once access is granted or a file is downloaded, the content has been delivered in its entirety and the value has been transferred. Miavela operates a strict no-refund policy on all digital purchases, including but not limited to:

•       The Insulin Code and any future paid PDF protocols

•       Digital courses or programs

•       Email-delivered content or sequences purchased as standalone products

•       Bundle products containing any of the above

2.  EU Consumer Rights — Mandatory Disclosure

Under European Union consumer law (Directive 2011/83/EU on Consumer Rights), consumers normally have a 14-day right of withdrawal from distance contracts. However, this right of withdrawal does NOT apply to digital content where:

•       Delivery has begun with the consumer's prior express consent, AND

•       The consumer has acknowledged that they thereby lose their right of withdrawal

By completing your purchase and checking the mandatory consent checkbox at checkout, you expressly consent to immediate delivery of the digital content and acknowledge that you waive your 14-day right of withdrawal. This waiver is legally valid under Article 16(m) of Directive 2011/83/EU.

3.  Exceptions — When a Refund May Be Considered

Miavela may, at its sole discretion, offer a resolution in the following exceptional circumstances only:

•       You were charged more than once for the same product due to a technical error — verified by payment records.

•       The file delivered was fundamentally defective.

These exceptions do not apply if: you changed your mind after purchase; you did not read the product description before purchasing; you found the same information elsewhere for free; or the content did not produce a health outcome you expected.

5.  Free Products

Free lead magnets and free materials distributed by Miavela are provided at no cost and carry no refund considerations. They remain subject to all intellectual property terms described in the full Terms and Conditions.
